Ordinance Nº 427, March 22nd 2005

Establishing the National Commission for Monitoring and Evaluation of the Implementation of the National Pact for the Reduction of Maternal and Neonatal Mortality and give other provisions.

THE MINISTER OF STATE FOR HEALTH, in exercise of its powers, and

Considering there are high rates of Maternal and Neonatal Mortality in the Country;

Considering maternal mortality and neonatal mortality in Brazil constitute a violation of human rights of women and a serious public health problem;

Considering facing the problem of maternal and neonatal mortality implies the involvement of different social actors, in order to ensure that national policies are indeed implemented and meet the real needs of the local population;

Considering the launch of the National Pact for the Reduction of Maternal and Neonatal Mortality in March 8th, 2004, by the President, and

Considering the approval of the National Pact for the Reduction of Maternal and Neonatal Mortality in March 18th, 2004 by the Tripartite Commission, Determines:

Article 1st. To establish the National Monitoring and Evaluation of the Implementation of the National Pact for the Reduction of Maternal and Neonatal Mortality as a technical-advisory function with the following objectives:

I - to evaluate systematically the implementation of the National Pact for the Reduction of Maternal and Neonatal Mortality in Brazil;

II - to propose action strategies, policies, legal instruments and ethical principles to make the implementation of the National Pact for the Reduction of Maternal and Neonatal Mortality;

III - to monitor the actions of managers in federal, state and municipal governments in the process of implementation of the accepted commitments and in the articulation and integration of different institutions and bodies involved in implementing the National Pact for the Reduction of Maternal and Neonatal Mortality, and

IV - to promote the actions undertaken in order to accomplish the Covenant in question.

Article 2nd. The National Commission for Monitoring and Evaluation of the Implementation of the National Pact for the Reduction of Maternal and Neonatal Mortality will be coordinated by Adson FRANCE ROBERTO DOS SANTOS, Department of Health Care, and will have the following composition:

I - Ministry of Health:
a) Department of Strategic Programmatic Actions, the Department of Health Care - four representatives;
b) Secretariat of Health Surveillance - one representative;
c) Secretariat of Participative Management - one representative;
d) Department of Labor Management and Health Education - one representative;
e) National Health Council - one representative;

f) Department of Indigenous Health, from the National Health Foundation - one representative, and

g) National Supplementary Health Agency - one representative.

II - Special Secretariat for Policies for Women - one representative;
III - Special Secretariat for Policies to Promote Racial Equality - one representative;
IV - Special Secretariat for Human Rights - one representative;
V - National Council of Health Secretaries - one representative;
VI - National Council of Municipal Secretaries of Health - one representative;
VII - National Council of Child and Adolescent - one representative;
VIII - Federal Medical Council - one representative;
IX - Brazilian Medical Association - one representative;
X - Brazilian Federation of Gynecology and Obstetrics - one representative;
XI - Brazilian Society of Pediatrics - one representative;
XII - National Network of Human Milk Banks - one representative;
XIII – Children’s Pastoral - one representative;
XIV - Brazilian Nursing Association - one representative
XV - Brazilian Association of Obstetrical Nursing - one representative;
XVI - National Feminist Network for Health and Reproductive Rights - one representative;
XVII - Articulation of Women in Brazil - one representative;
XVIII - Confederation of Women in Brazil - one representative;
XIX - Articulation of Black women's NGOs - one representative;
XX - Network for the Humanization of Labor and Delivery - one representative;
XXI - National Network of Traditional Midwives - one representative, and
XXII - Brazilian Association of Graduate Programs in Public Health - one representative.

Article 3rd. The following representatives will be invited-members for the National Monitoring and Evaluation of the Implementation of the National Pact for the Reduction of Maternal and Neonatal Mortality:

I – the United Nations Fund for Population Activities (UNFPA), the Pan American Health Organization (PAHO);
II – the Fund of the United Nations Children's Fund (UNICEF), the Cochrane Center of Brazil / UNIFESP; and
III – the International Network in Defense of the Right to Breastfeed and the World Alliance for Breastfeeding.

Article 4th.  The Internal Rules of the National Monitoring and Evaluation of the Implementation of the National Pact for the Reduction of Maternal and Neonatal Mortality will be published in an act of the Secretary of Health Care

Article 5th. This Ordinance shall enter into force upon its publication.
