ORDINANCE Nº 2324, OCTOBER 6th 2009

It establishes the annual transfer fund to fund for the structuring and implementation of the actions for Food and Nutrition in the Departments of State and Municipal Health based on National Policy for Food and Nutrition.

THE MINISTER OF STATE FOR HEALTH, in exercise of its powers, and

Considering Ordinance No. 648/GM of March 28, 2006, which establishes the policy of Primary Health Care;

Considering Ordinance No. 710/GM of June 10, 1999 that approves the National Policy for Food and Nutrition;

Considering Ordinance No. 154/GM of January 24, 2008, establishing the Centers of Support for Family Health - NASF;

Considering Ordinance No. 325/GM of February 21, 2008, establishing priorities, goals and objectives of the Covenant for Life for the year 2008, the indicators for monitoring and evaluation of the Pact for Health and the orientation, deadlines and guidelines for that pacts;

Considering Ordinance No. 2.246/GM of October 18, 2004, which establishes and disseminates basic guidelines for the implementation of Actions for Food and Nutrition Surveillance within the basic health of the Unified Health System - SUS, in all national territorry;

Considering the Interministerial Ordinance No. 2509 of November 18, 2004, which provides for the duties and standards for the provision and monitoring of health conditionalities relating to families receiving the Family Grant Program;

Considering Ordinance No. 2.362/GM of December 1, 2005, restructuring the National Program for Prevention and Control of Iodine Deficiency Disorders - IDD, called Pro-iodine;

Considering Ordinance No. 729/GM of May 13, 2005, establishing the National Vitamin A supplementation;

Considering Ordinance No. 730/GM of May 13, 2005, establishing the National Iron Supplementation to prevent iron deficiency and anemia;

Considering the Interministerial DM / ECM No. 1010 of May 8, 2006, establishing guidelines for the Promotion of Healthy Eating in Schools of kindergarten, elementary and middle level of public and private school networks in all national territorry;

Considering the Ordinance No. 687/GM of March 30 and 2006 approving the National Policy for Health Promotion, and

Considering the necessity to implement the actions of food and nutrition in the context of primary health care aimed at promoting healthy eating, support and monitoring of food and nutrition situation of the population and support for prevention and control of malnutrition and implementation of National Programs Supplementation of Iron and Vitamin A, resolves:

Article 1. To set financial resources for the actions of Food and Nutrition for Health to encourage the structuring and implementation activities for Food and Nutrition by the State Departments and the Municipal Health

§ 1 The Municipalities of the caput of this Article are those that have more than 150,000 inhabitants.

§ 2 The funds will be deposited into the State or the Municipal Health Funds in a single annual portion according to the values laid out in Appendix I and II.

§ 3 The municipalities, states and Federal District must conform to the provisions of art. 4 of Law No. 8142 of December 28, 1990 in order to receive the funds transfer from fund to fund,.

Article 2. To determine what financial resources are transferred to the effective implementation of the National Policy for Food and Nutrition, based on their guidelines:

I - promotion of healthy dietary practices and lifestyles;

II - monitoring the food and nutrition situation;

III - Prevention and control of nutritional disorders and diseases related to diet and nutrition, and

IV - development and training of human resources in health and nutrition.

Sole Paragraph. The financial resources related to this Ordinance must not be used for the purpose of treating disease or rehabilitation of patients, including in food acquisition, dietary supplements, formulas, food, vitamins or minerals for these purposes.

Article 3. To determine that, for maintaining the transfer of resources related to this Ordinance, the actions and targets for Food and Nutrition must be listed in the State, the Municipalities and the Federal District Health Plans, including their Annual Programme, .

Sole Paragraph. The results of the actions and activities developed with the financial resources related to this Ordinance shall be submitted to the Annual Management Report of the State, Municipalities and Federal District, which is the subject of Ordinance No. 3.085/GM of December 1, 2006.

Article 4. To establish that it is the responsibility of the Ministry of Health:

I - to establish guidelines for the actions of Food and Nutrition to be developed based on National Policy for Food and Nutrition;

II - to encourage and support State and Municipal Health Department for the deployment, implementation and evaluation of performance and impact of the shares of food and nutrition, with the scientific-technical support of the Collaborating Centres in Food and Nutrition;

III – to create mechanisms to link the transfer of resources to state and municipal bodies to the single development of actions for Food and Nutrition;

IV - participate in the negotiation of targets to be agreed with the states in the realization of the Pact for Health;

V - to promote mechanisms for the consolidation of the System of Food and Nutritional Surveillance (SISVAN) for mapping and monitoring of malnutrition, excess weight and other nutritional problems;

VI – to track and monitor the situation of the States, the Federal District and Municipalities in the level of deployment and operational infrastructure for Food and Nutrition;

VII - to monitor, through the National Audit Department of SUS - DENASUS the conformity of the implementation of the resources transferred to States, the Federal District and Municipalities, based on annual management reports sent by the Secretariats of Health from the States, Federal District and Municipalities;

VIII - to establish partnerships with other governmental and nongovernmental bodies, agencies and institutions for the development of complementary activities, aiming to promote healthy nutrition and

IX – to assess performance and impacts of actions taken at national level with the support of technical-scientific Collaborating Centres in Nutrition.

Article 5. To establish that it is the responsibility of State Health Departments:

I– to set within the Inter-managers Bipartite Commission the technical cooperative actions with the municipalities, considering the regional priorities established in the Collegiate Regional Management;

II – to qualify the structure of human resources responsible for coordinating the technical statewide area by the actions of Food and Nutrition;

III – to indicate a head technician, health professional, to assume the coordination of state shares of food and nutrition, and recommending the appointment of a professional nutritionist;

IV - to set the goals of the indicators related to food and nutrition in the Pact for Health, along with municipal managers in the Inter-managers Bipartite Commission.

V - stimulate and support the municipalities for the deployment, implementation and impact assessment of the actions of Food and Nutrition;

VI - to formulate and implement the State Policy for Food and Nutrition;

VII - to train and supervise the municipalities regarding the implementation and operationalization of the shares of Food and Nutrition;

VIII - to monitor, track the status of municipalities and encourage them to implement and meet the goals of the Pact for Health relating to the National Food and Nutrition and others as may be agreed upon in the Inter-managers Bipartite Commission;

IX - to encourage, assist and monitor implementation of the Food and Nutrition Surveillance in municipalities, in accordance with the standards established in pertinent legislation and the specific technical materials;

X - to promote and assist in implementing the strategy to promote healthy food supplement for children under 2 years of age;

XI - to produce publications on the situation of food and nutrition at the State level;

XII – to develop technical materials for health professionals and / or the population (manuals, videos, newsletters, brochures, posters etc.).

XIII – to develop actions aimed at promoting healthy eating to the population, with emphasis on regional food, especially fruits and vegetables;

XIV - carry out training events or exchanges of experiences in food and nutrition (seminars, workshops, forums, etc.).

XV – to supporting studies, research and evaluation activities of the shares of food and nutrition at the state level;

XVI - to evaluate the performance and impact of food and nutrition actions at the state level;

XVII – monitoring compliance of the application of resources transferred to municipalities, based on the Annual Reports of Management;

XVIII – to determine that the actions and targets set in national programs of iron supplementation and supplementation of vitamin A are implemented and monitored under the law and / or specific standards;

XIX – to support the participation of technical events in Food and Nutrition, and

XX – to facilitate the purchase of anthropometric equipment (scales, anthropometers, tapes) or (computers, printers, etc.).

Article 6. To establish the responsibilities of the Municipal Health Departments:

I – to regulate the actions of food and nutrition to be developed based on the guidelines of the National Food and Nutrition;

II – to indicate a head technician, health care, to coordinate the actions of food and nutrition, and recommended the appointment of a professional nutritionist;

III - to formulate and implement the municipal politics of food and nutrition;

IV - to organize the network of care food and nutrition within the health sector in its territory, which is to regulate the activities and work processes in primary care in specialized centers and in hospital;

V - to carry out technical support to teams of primary care, the Program for Community Agents of Health, the Family Health and Support Center for Family Health and to carry out the actions of food and nutrition in the network of basic health care;

VI - to encourage actions to reduce malnutrition and elimination of severe malnutrition in the network of basic health care;

VII - to promote prevention and control of nutritional disorders and diseases related to diet and nutrition such as obesity and eating disorders;

VIII - to implement a strategy to promote healthy food supplement for children under 2 years of age;

IX - promoting healthy eating, based on the guidelines of the Brazilian  Population Food Guide, designed to contribute to the prevention and control of nutritional deficiencies and chronic non-communicable diseases;

X - promote educational activities to encourage the consumption of Brazilian regional food, especially fruits and vegetables;

XI - to monitor food and nutrition situation of the population through the System of Food and Nutrition Surveillance - SISVAN;

XII - deploy and meet the goals of the Pact for Health relating to the National Food and Nutrition and others as may be agreed upon in the Bipartite Commission - CIB;

XIII - supporting studies, research and evaluation activities of the shares of food and nutrition at the municipal level;

XIV - prepare reports and reports on the situation of food and nutrition at the municipal level;

XV - develop technical materials for health professionals and / or the population (manuals, videos, newsletters, brochures, posters etc.).

XVI-hold training events or exchanges of experiences in food and nutrition (seminars, workshops, forums, etc.);

XVII - partnering to support the implementation of the shares of food and nutrition at the municipal level;

XVIII - record information by monitoring of iron supplementation and vitamin A by instruments offered by the Ministry of Health, as defined periodicity in specific technical material;

XIX - support the participation of technicians events in Food and Nutrition, and

XX - facilitating the purchase of anthropometric equipment (scales, anthropometers, tapes) or (computers, printers, etc.).

Article 7. To establish that the acquisition of permanent materials should be related to the structuring of the shares of food and nutrition, and these materials can not be used for other purposes.

Article 8. To Determine that actions are monitored and evaluated based on goals set out in the State Departments Annual Schedule, the Federal District and Municipal Health as the Ordinances, No. 3.085/GM of December 1, 2006, No 3332 / GM, December 28, 2006, and No. 3.176/GM of December 24, 2008, which respectively regulate the Planning System of SUS and approves general guidelines about the basic tools.

Article 9. To establish that the resources mentioned in this Ordinance are part of Block Funding for the Management of the SUS, as Ordinance No. 204/GM of January 29, 2007, which regulates the funding and transfer of federal resources for actions and health services in the form of chunks of funding.

Article 10. To establish that budget resources, object of this Ordinance, be borne by the budget of the Ministry of Health, and encumber the Work 10.306.1214.8735.0001 Food and Nutrition for Health in the amount of R$ 8,630,000.00.

Article 11. This Ordinance shall enter into force upon its publication.
